1. Introduction
Welcome to Fancy! These Terms and Conditions ("Terms") govern the rental of jewelry goods from our website. By accessing or using our website to rent items, you agree to these Terms. Please read them carefully before proceeding.
2. Definitions
"Fancy," "we," "us," or "our" refers to the company operating the jewelry rental service.
"User," "you," or "your" refers to any individual renting jewelry through our website.
"Item" or "Goods" refers to the jewelry or other valuable items available for rent.
"Deposit" is a security amount paid by the User to ensure the safe return of the rented Item in its original condition.
"Rental Period" is the duration during which the User is authorized to use the rented Item.
"Portal" refers to Fancy's website or application where the rental process is facilitated.
3. Rental Process
3.1. Users must create an account on the Portal and provide personal details to access the rental services.
3.2. The rental process includes selecting an Item, paying a reservation fee online, and completing the necessary agreements at the store before taking possession of the Item.
3.3. Users must sign a rental contract and evaluation document, pay the full rental fee, and leave a Deposit before collecting the Item.
4. Payment Terms
4.1. The rental fee and deposit amount will be specified on the Portal and in the rental agreement.
4.2. Payments can be made online through the Portal or in person at the store.
4.3. The Deposit amount is set at 100% of the Item’s value and is refundable upon the return of the Item in acceptable condition.
5. User Responsibilities
5.1. Users must inspect and accept the condition of the Item at the time of collection. Any defects or discrepancies must be documented and acknowledged by both parties.
5.2. Users must handle the Items with care and return them by the agreed-upon deadline.
5.3. Users may not transfer or sublease the rented Item to any third party.
6. Return and Late Fees
6.1. The User must return the Item by the end of the Rental Period.
6.2. If the return date falls on a non-working day, the Item must be returned on the next business day.
6.3. Late returns are subject to the following penalties:
Up to 4 days late: A daily late fee of 200% of the daily rental rate.
More than 4 days late: The full Deposit will be retained.
6.4. If an Item is considered lost (more than 4 days late or otherwise unrecoverable), the User is liable for the Item’s full value as stated in the initial agreement.
7. Item Condition and Damage
7.1. The Item must be returned in the condition documented at the time of collection, accounting for normal wear and tear.
7.2. Any damage or deterioration beyond normal use will result in deductions from the Deposit or additional charges as determined by an evaluation conducted by Fancy.
7.3. In the event of significant damage or loss, the User is liable for the full replacement cost of the Item.
8. Termination and Cancellation
8.1. Fancy reserves the right to terminate the rental agreement immediately in the case of fraud, misrepresentation, or breach of these Terms.
8.2. Users may cancel a reservation prior to collecting the Item, subject to cancellation fees as outlined on the Portal.
9. Privacy and Confidentiality
9.1. Any personal information collected during the rental process will be handled in accordance with our Privacy Policy.
9.2. Both parties agree to maintain the confidentiality of any proprietary or sensitive information exchanged during the rental process.
10. Disputes and Governing Law
10.1. Any disputes arising from this agreement will be resolved through negotiation. If negotiations fail, the dispute will be subject to the jurisdiction of the courts of the Republic of Azerbaijan.
11. Amendments
11.1. Fancy reserves the right to amend these Terms at any time with prior notice of at least 14 days. Continued use of the rental services after the notice period constitutes acceptance of the updated Terms.
